Welcome to PureLane Goodyear Landscaping. By using our services or accessing our website, you agree to these Terms of Service. Please read them carefully before engaging our services.
1. Services Provided
PureLane Goodyear Landscaping provides professional landscaping services including but not limited to lawn care and maintenance, landscape design and installation, hardscaping, irrigation system installation and repair, tree trimming and removal, sod installation, outdoor lighting, drainage solutions, seasonal cleanups, commercial landscaping, mulching and bed maintenance, and artificial turf installation. All services are subject to availability and scheduling.
2. Estimates and Pricing
We provide free estimates for our services. All estimates are valid for 30 days from the date of issue unless otherwise specified. Pricing may vary based on site conditions, material costs, and project scope. We reserve the right to adjust pricing if unforeseen circumstances arise during project execution. Any price changes will be communicated to you before proceeding with additional work.
3. Payment Terms
Payment terms will be specified in your service agreement or invoice. For ongoing maintenance services, payment is typically due upon completion of service. For larger projects, we may require a deposit before work begins, with the remaining balance due upon project completion. We accept various payment methods including cash, check, and credit cards. Late payments may be subject to interest charges or late fees as permitted by law.
4. Scheduling and Cancellations
We will make every effort to arrive at your property during the scheduled time window. Weather conditions, equipment issues, or other unforeseen circumstances may require rescheduling. We will notify you as soon as possible if we need to change your scheduled service. If you need to cancel or reschedule a service, please provide at least 24 hours notice to avoid cancellation fees.
5. Property Access and Safety
You agree to provide clear access to the work areas and notify us of any potential hazards on your property including underground utilities, sprinkler systems, pet enclosures, or unsafe structures. It is your responsibility to ensure pets are secured during service visits. We are not responsible for damage caused by unmarked underground utilities or hazards that were not disclosed to us prior to beginning work.
6. Warranties and Guarantees
We stand behind the quality of our work. Plant materials typically carry a limited warranty as specified in your service agreement. Hardscape installations are guaranteed against defects in workmanship for a specified period. Living plant materials are subject to natural conditions and require proper care and maintenance to thrive. We cannot guarantee plant survival if proper watering and care instructions are not followed.
7. Limitation of Liability
PureLane Goodyear Landscaping maintains liability insurance to protect our clients and our business. However, our liability is limited to the amount paid for the specific service that gave rise to the claim. We are not liable for indirect, incidental, or consequential damages. In the event of a dispute, both parties agree to attempt resolution through good faith negotiation before pursuing legal action.
8. Changes to Services
If you request changes to the scope of work after a project has begun, we will provide a change order detailing the modifications and any associated cost adjustments. Change orders must be approved in writing before additional work proceeds. We reserve the right to decline change requests that significantly alter the project scope or timeline.
9. Intellectual Property
All landscape designs, plans, and proposals created by PureLane Goodyear Landscaping remain our intellectual property unless otherwise agreed in writing. You may use approved designs for the specific property and project for which they were created, but you may not reproduce or distribute our designs without permission.
10. Termination of Service
Either party may terminate ongoing service agreements with written notice as specified in the service agreement. For one-time projects, termination after work has begun may result in charges for work completed and materials purchased. Any outstanding balances must be paid in full upon termination.
11. Dispute Resolution
In the event of any dispute arising from our services, both parties agree to first attempt resolution through direct communication and good faith negotiation. If a resolution cannot be reached, the dispute will be resolved through binding arbitration in accordance with Arizona state law.
12. Changes to Terms
We reserve the right to update these Terms of Service at any time. Changes will be posted on our website with the updated date. Your continued use of our services after changes are posted constitutes acceptance of the revised terms.
